CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN POLICY AT LEVISELL

GENERAL:

When you place an order electronically through Levisell.com, the pre-contractual information obligations and the distance selling agreement are deemed accepted.

Buyers are subject to the provisions of Law No. 6502 on Consumer Protection and the Distance Selling Regulation (Official Gazette: 27.11.2014/29188) as well as all applicable laws regarding the purchase and delivery of the products they acquire.

Shipping costs for the product being shipped are the responsibility of the buyer.

Each purchased product will be delivered within the statutory period of 30 days to the person and/or institution specified by the buyer. If the product is not delivered within this period, buyers may cancel the contract.

The purchased product must be delivered in full and according to the specifications stated in the order, and must include a warranty certificate and user manual if applicable.

If the sale of the purchased product becomes impossible, the seller must inform the buyer in writing within 3 days. The entire amount must be refunded to the buyer within 14 days.

IF THE PRICE FOR THE PURCHASED PRODUCT IS NOT PAID:

If the buyer fails to pay the price for the purchased product or if the payment is canceled in the banking system, the seller's obligation to deliver is extinguished.

PURCHASES WITH UNAUTHORIZED USE OF THE CREDIT CARD:

If it turns out after the delivery of the product that the buyer's credit card was misused by unauthorized persons and the price for the sold product is not paid to the seller by the relevant bank or financial institution, the buyer is obliged to return the contractual product to the seller within 3 days. In this case, shipping costs will be borne by the seller.

PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN CIRCUMSTANCES:

In the event of unforeseen force majeure and the product cannot be delivered on time, the buyer will be informed. The buyer may request the cancellation of the order, the exchange of the product, or the postponement of the delivery until the obstacle is removed. If the buyer cancels the order, the amount paid will be refunded within 14 days if the payment was made in cash. If the buyer has paid by credit card and cancels, the amount will also be refunded to the bank within 14 days. However, it may take 2-3 weeks for the bank to transfer the amount to the buyer's account.

BUYER'S OBLIGATION TO CHECK THE PRODUCT:

The buyer is obliged to check the contractual product before acceptance and not to accept damaged or defective products, such as crushed, broken, or damaged packaging, from the carrier. Once the product is accepted, it is considered intact and in good condition. The buyer is obliged to handle the product carefully after delivery. If the right of withdrawal is exercised, the product must not be used. The invoice must be returned along with the product.

RIGHT OF WITHDRAWAL:

The buyer can exercise the right of withdrawal by sending a notification to the seller within 14 (fourteen) days from the delivery date of the purchased product, using the contact details provided below. This can be done without any legal or penal responsibility and without stating any reasons. It is important for buyers to contact sellers to carry out the withdrawal properly.

WITHDRAWAL PERIOD:

If the buyer purchases a product or service, the period of 14 (fourteen) days begins from the date of the contract conclusion. In service contracts that are started with the consent of the consumer before the withdrawal period expires, the right of withdrawal cannot be exercised.

The costs arising from the exercise of the right of withdrawal are borne by the seller.

To exercise the right of withdrawal, the buyer must send a written notice to the seller via registered mail, fax, or email within 14 (fourteen) days. The product must not have been used in accordance with the provisions of this contract regarding “products for which the right of withdrawal cannot be exercised.”

APPLICATION OF THE RIGHT OF WITHDRAWAL:

The invoice for the delivered product must be returned (If the invoice for the returned product is issued to an institution, the return must be made along with the return invoice issued by that institution. Returns issued in the name of institutions cannot be completed if a return invoice is not issued).

The return form and the product must be returned completely and undamaged along with the original packaging and, if available, standard accessories.

RETURN CONDITIONS:

The seller is obliged to refund the total amount and the documents that obligate the buyer within 10 days of receiving the withdrawal notification and to take back the product within 20 days.

If a depreciation in value occurs due to the buyer's fault or if the return becomes impossible, the buyer is obliged to compensate the seller for the damages incurred due to their fault. However, the buyer is not responsible for changes or damages that occur due to the proper use of the product within the withdrawal period.

If the action performed by the seller due to the exercise of the right of withdrawal falls below the specified campaign limit, the amount of the discount granted will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL DOES NOT APPLY:

Products that have been prepared at the request of the buyer or according to their specific needs and that cannot be returned, such as underwear, swimsuits, bikinis, cosmetics, disposable items, perishable goods, or products that may have an approaching expiration date, as well as products whose packaging has been opened after delivery and whose return is not permissible for health and hygiene reasons, are excluded from return. In addition, products that have been mixed with other products after delivery and cannot be separated by their nature, as well as periodic publications such as newspapers and magazines provided under a subscription agreement, and services provided immediately in electronic form or intangible goods delivered immediately to the consumer, are also excluded from return. The return of audio or video recordings, books, digital content, software programs, data storage devices, and computer consumables is only possible if their packaging has not been opened.

DEFAULT AND LEGAL CONSEQUENCES:

If the buyer makes the payment by credit card and falls into default, the buyer agrees that they will have to pay interest under the credit card agreement with the bank and will be responsible to the bank. In this case, the bank may take legal action; the costs incurred and attorney fees may be claimed from the buyer, and in any case, if the buyer falls into default due to their debt, the buyer agrees to compensate the seller for damages incurred due to the delayed fulfillment of the debt.
